Chấm dứt hoạt động bán hàng đa cấp của Thiên ngọc Minh Uy

Bộ Công thương cho biết đã tiến hành quy trình chấm dứt hoạt động bán hàng đa cấp của Công ty TNHH Thiên Ngọc Minh Uy, theo đề xuất trước đó của doanh nghiệp.
Ngày 25.4, trong thông báo vừa phát đi, Bộ Công thương cho hay đã tiến hành quy trình chấm dứt hoạt động bán hàng đa cấp của Công ty TNHH Thiên Ngọc Minh Uy, có địa chỉ trụ sở chính tại đường Đồng Bông, phường Dịch Vọng Hậu, quận Cầu Giấy, Hà Nội.
Thông báo nói rằng “quan điểm của Bộ Công thương là xử lý nghiêm minh các vi phạm của Công ty TNHH Thiên Ngọc Minh Uy”. Tuy nhiên, điều đáng chú ý là trước đó, công ty này đã chủ động nộp hồ sơ chấm dứt hoạt động bán hàng đa cấp.

Đáng nói ở chỗ là, cũng theo thông báo kể trên, thống kê từ các Sở Công Thương cho thấy riêng trong năm 2016, Công ty TNHH Thiên Ngọc Minh Uy cùng các đại lý và người tham gia bán hàng đa cấp của mình đã thực hiện 80 lượt vi phạm đối với 13 hành vi quy tại 34 tỉnh, thành phố trực thuộc trung ương và đã bị xử phạt tổng cộng hơn 1,5 tỉ đồng.
Cùng với thực hiện quy trình cho phép doanh nghiệp chấm dứt bán hàng đa cấp, Cục Quản lý cạnh tranh (Bộ Công thương) cũng đã ban hành quyết định xử lý đối với doanh nghiệp này 140 triệu đồng đối với 3 hành vi vi phạm, gồm: Ký hợp đồng tham gia bán hàng đa cấp với người tham gia bán hàng đa cấp không bao gồm đầy đủ các nội dung cơ bản theo quy định của pháp luật; không thực hiện đầy đủ nghĩa vụ đào tạo cơ bản về bán hàng đa cấp cho người tham gia bán hàng đa cấp theo quy định pháp luật và duy trì nhiều hơn một mã số kinh doanh đa cấp đối với cùng một người tham gia bán hàng đa cấp.
Ngoài ra, Cục Quản lý thị trường của Bộ này đã xử phạt Công ty TNHH Thiên Ngọc Minh Uy tổng cộng 75 triệu đồng đối với 2 hành vi: Không thông báo với Sở Công thương các tỉnh, thành phố trực thuộc T.Ư nơi doanh nghiệp có hoạt động bán hàng đa cấp sau khi sửa đổi, bổ sung Giấy chứng nhận đăng ký hoạt động bán hàng đa cấp; kinh doanh hàng hóa có nhãn ghi không đúng các nội dung bắt buộc phải thể hiện trên nhãn theo tính chất hàng hóa.
Trước đó, hồi tháng 1, Bộ Công thương cũng đã công bố kết quả kiểm tra 2 doanh nghiệp lớn bán hàng đa cấp là Công ty Thiên Ngọc Minh Uy và Công ty Amway Việt Nam với nhiều dấu hiệu vi phạm. Trong đó, đối với Thiên Ngọc Minh Uy, kết quả kiểm tra cho thấy một số sản phẩm thực phẩm chức năng tại kho của công ty có nhãn gốc chưa đúng với nhãn gốc đã đăng ký với Cục An toàn thực phẩm. Điều này là có dấu hiệu vi phạm quy định về ghi nhãn sản phẩm và lưu thông hàng hóa chưa đủ điều kiện trên thị trường.
Bên cạnh đó, một số hợp đồng tham gia bán hàng đa cấp của Công ty ký với nhà phân phối không ghi đầy đủ thông tin của nhà phân phối theo quy định.

Bộ Công thương vừa công bố kết quả kiểm tra hai doanh nghiệp lớn bán hàng đa cấp là Công ty Thiên Ngọc Minh Uy và Công ty Amway Việt Nam với nhiều dấu hiệu vi phạm.

Công ty này cũng chưa thực hiện việc đào tạo cơ bản, cấp chứng chỉ đào tạo cơ bản về bán hàng đa cấp và cấp thẻ thành viên mạng lưới bán hàng đa cấp theo quy định cho toàn bộ nhà phân phối đang hoạt động. Ngoài ra, đoàn kiểm tra còn phát hiện trường hợp nhà phân phối không có tên trong danh sách đào tạo cơ bản về bán hàng đa cấp của doanh nghiệp, nhưng vẫn được cấp chứng chỉ đào tạo cơ bản về bán hàng đa cấp. Các hành vi này có dấu hiệu vi phạm Nghị định 42 về bán hàng đa cấp.

Cùng với đó, doanh nghiệp không xuất trình được bằng chứng chứng minh rằng công ty đã thực hiện nghĩa vụ thông báo tới một số sở công thương đối với các lần sửa đổi, bổ sung giấy chứng nhận đăng ký hoạt động bán hàng đa cấp lần thứ 3, thứ 4 và thứ 5 tại nhiều địa phương.
Đáng chú ý, đối với các sản phẩm mỹ phẩm Kang Yi Dao, Thiên Ngọc Minh Uy cung cấp thêm dịch vụ chăm sóc sức khỏe, cụ thể là cử nhân viên hướng dẫn cách sử dụng và sử dụng sản phẩm để massage cho khách hàng theo các liệu trình tại Công ty hoặc một số đại lý của Công ty.
Cơ quan kiểm tra cho rằng việc cung cấp dịch vụ massage, chăm sóc sức khỏe kèm theo dòng sản phẩm mỹ phẩm Kang Yi Dao có nhiều khả năng gây hiểu nhầm là công ty này kinh doanh dịch vụ chăm sóc sức khỏe theo phương thức đa cấp, không phù hợp với đối tượng kinh doanh bán hàng đa cấp theo quy định.
